Divorce is one of the truths of our society and its implications on the continued of real estate and the near future purchasing ability of both parties should be important factors before  agreements are made.  All involved should be able to make informed decisions about many of the issues (including true costs) that can affect the decision for one party to stay and ability to refinance.  These issues also affect the party leaving the home in their ability to be clear of the property entirely and be able to secure a new mortgage.
